Deadly hit-and-run accident driver arrested in China

BELGRADE -- Serbia will seek the extradition from China of Marko Milićev, suspected of causing a traffic accident in Belgrade that killed a 21-year-old man.

The Tanjug news agency learned from the Ministry of Justice that since there is no bilateral extradition agreement between Serbia and China, "the principle of mutuality will apply."

Professor of Criminal Procedural Law at the Law Faculty Milan Škulić pointed out that when there is no extradition treaty, as in the case with China, a so-called legal extradition is carried out under the rules prescribed by the laws of both countries.

"It means that we will submit our extradition request in accordance with our provisions on international legal assistance along with the evidence showing that the person had committed the offense," said the professor.

China, on the other hand, will consider our request according to its laws, and if the request fulfills legal requirements, will decide to extradite the suspect.

China is not bound by any deadlines, other than those found it its laws.

Marko Milićev was arrested in China on a Serbian Interpol warrant on suspicion that he struck Luka Jovanović with his vehicle on June 25 in Belgrade, and fled the scene. The victims died from his injuries shortly after.

Milićev was on the run since he left Serbia on August 10 on a flight to Istanbul, Turkey.

The Belgrade-based daily Politika is reporting on Tuesday that Milićev's arrest in China came on drug charges, and was unrelated to the Serbian warrant over the traffic accident.
