President Iohannis calls on Parliament to review of the law on statutes of judges and prosecutors

President Klaus Iohannis on Friday sent Parliament for re-examination a piece of legislation amending and supplementing Law 303/2004 on the statutes of judges and prosecutors.

In his request for re-examination to Speaker of the Chamber of Deputies Liviu Dragnea, Iohannis argues this law concerns substantive legislative interventions in one of the most important pieces of legislation regulating the activity of the judiciary.

He says the Constitutional Court of Romania (CCR) has found unconstitutional 12 points in the law amending Law 303/2004 and a significant number of provisions and wordings closely related to them.

"However, a number of provisions in the law forwarded for promulgation continue to raise issues, some of which are, in themselves, unclear and contradictory, with serious consequences on the quality requirements of the law imposed by the Constitution that are likely to generate a strong negative impact on the smooth operation of the judiciary. At the same time, some of the regulations lack coherence and predictability, as they are not correlated with other provisions of the laws that make up the 'legislative package' in the field of judicial reform (the law amending and supplementing Law 304/2004, and the law amending and supplementing Law 317/2004), which could affect the constitutional requirements in terms of independence and smooth operation of the judiciary," reads the request.
