Constitutional Court: Brussels Agreement a political act

BELGRADE - The Constitutional Court of Serbia confirmed on Monday that it has dismissed an initiative to assess the constitutionality and legality of the Brussels Agreement, announcing that the full text of the conclusion and a detailed explanation will be promulgated by publication in the Official Gazette.

In a communication submitted to Tanjug, the Constitutional Court said that, at its session of December 10, a conclusion was adopted whereby a motion to assess the constitutionality and legality of the April 19, 2013 First Agreement of Principles Governing the Normalisation of Relations, initialled between the Government of the Republic of Serbia and interim institutions in Pristina, was dismissed.

The Constitutional Court is of the opinion that, in its nature, the Brussels Agreement is not an international agreement or a general legal act, as claimed by the petitioner, but a political act resulting from a process of political dialogue, the communication said.

The Court's decision is a "result of a comprehensive analysis of specific elements of the Agreement, conducted by the Court by assessing the various arguments presented in a public debate by invited experts in international public law and constitutional law," the Court noted.

The motion to assess the constitutionality of the agreement was filed by the Democratic Party of Serbia.
